Important 2015 Rewards Program Changes:

As a result of the closing of IZOD Company Stores, the following changes will occur that will affect your participation in the current Rewards program:

  • From now until July 31, 2015, Rewards members will be able to continue to enjoy the benefits of earning and redeeming rewards at IZOD Company Stores and Van Heusen Company Stores.
  • Beginning August 1, 2015, the 2-brand Rewards program WILL END. A single brand program, Van Heusen Rewards, will replace the 2-brand program.

The Following Changes Occur August 1, 2015

  • IZOD Rewards & Van Heusen Rewards members will no longer be able to earn points on IZOD Company Store purchases.
  • IZOD Rewards & Van Heusen Rewards members can still redeem earned rewards at all Van Heusen Company Stores and IZOD Company Stores.
  • IZOD Rewards members will remain enrolled in the program and can still earn points at all Van Heusen Company Stores.

Rewards Program Announcement & Eligibility

All customers are invited to become PVH Rewards (Program) members by completing a membership profile in one of the following ways:

  1. (1) by visiting www.vanheusen.com/rewards
  2. (2) by contacting customer service at 1-800-388-9122

A membership profile must be successfully completed in order for any customer to become a member (“Member”) of the Program.

Only Members are entitled to earn, accrue and use points and any Rewards issued pursuant to the Program.

As a Member, among other things, you agree to provide PVH with accurate, current, and complete information, and to update this information as it changes, to maintain your membership in the Program and your eligibility to receive Rewards. Any failure on your part to act in accordance with this obligation and/or the Program Terms & Conditions will be considered by PVH to be a breach of the Program Terms and Conditions.

There are no fees to join, and Members must be legal residents of the United States, Puerto Rico, Guam, Mexico or Canada, at least 18 years of age, and maintain a valid electronic mail (email) address.

Associates of PVH Corp. and its affiliates, and their immediate family members, are not eligible for membership.

PVH has the right, in its sole discretion, to modify, add or delete any of the Program rules, terms, conditions, or benefits, in whole or in part, at any time, with or without notice, even though such changes may reduce (or increase) the value of the Rewards or a Member’s benefits, except where prohibited by law. Continued participation in the Program constitutes acceptance of any modifications, additions or deletions.

All questions and interpretations concerning Program terms and conditions shall be resolved in the sole discretion of PVH, and by joining the Program, you expressly agree to be bound by PVH’s decisions.

Members consent to PVH accumulation, retention, and reasonable use of all information regarding their purchases acquired by PVH as a result of their participation in the Program.

The Program and participation therein is void where prohibited by law or where PVH would be obligated to apply for any special license, bonding, permit, or other government regulatory approval relating to the Program.

All references to dollars shall mean United States dollars.

Point Accumulation

Members earn 10 points per dollar spent on qualifying purchases. Qualifying purchases are purchases, excluding taxes, at any, Van Heusen Company Store or IZOD Company Store (purchases at IZOD Company Stores qualify only through July 31, 2015), of merchandise or gift cards. All qualifying purchase amounts are rounded up to the nearest dollar.

Purchases at other retail establishments are not qualifying purchases, including department stores or stores not owned and operated by PVH.

Points are not awarded for purchases made with merchandise credits or gift cards.

To ensure accurate accumulation and tracking of membership points, Members must provide their email address associated with their Rewards account, phone number associated with their Rewards account (if provided when you registered) or your Rewards Member ID # at the time of all purchase, exchange and return transactions.

Point balance accrual period is from February 1st through January 31st each year. Point balances accrue throughout the year, and Rewards are issued as thresholds (detailed in the Rewards section below) are met. On close of business January 31st, all account balances will be reset to zero and Rewards will be issued to each Member as follows:

  1. Customers with 1 – 500 points will receive a $5 Reward
  2. Customers with 501 – 999 points will receive a $10 Reward

Points will be deducted for all returns.

Upon submission of your completed customer profile, you will automatically earn 500 points.

PVH reserves the right to offer opportunities to obtain points and make promotional offers to select Members based on purchase activity, geographic location, Program participation or other information.

Points are issued for promotional purposes only when qualifying purchases are made.

Points have no fixed value and cannot be redeemed for cash.

Member accounts and points are not transferable and may only be used by an individual Member for the Member’s personal benefit. Member agrees that the Program and all associated points, Rewards, and benefits do not create any property rights in favor of Member.

Member points cannot be combined with points accrued in a separate Member’s account.

Qualifying purchases include only those purchases intended for personal use and not for resale purposes. If PVH has reason to believe that any purchases are being made for resale purposes, it reserves the right to disqualify the participant from the Program at any time, and/or to void, with or without notice, the point accumulation of participant, and/or to terminate such individual’s participation in the Program.

In the event a Rewards account is not utilized for a 24 month period, PVH reserves the right to cancel such Rewards account.

Points or Rewards may be subject to tax liability. Any tax liability or obligation, including disclosure, is the sole responsibility of the Member.

If you believe points have not been credited accurately to your Rewards account, please contact Customer Service at 1-800-388-9122, email us via the link provided for Van Heusen under the Contact Us section on www.vanheusen.com or write to: Rewards MS# 44, 1001 Frontier Road, Bridgewater, NJ 08807. Claims must be filed within 90 days from transaction date when points are alleged to have been earned.

PVH shall have no liability for failure, delay or error in crediting points to your Program account.

Rewards

Rewards are earned according to the following schedule:

  1. 1,000 points = $10 Reward
  2. 2,000 points = $20 Reward
  3. 3,000 points = $30 Reward
  4. 4,000 points = $40 Reward
  5. 5,000 points = $50 Reward
  6. Etc

New Members will receive a Welcome Reward for 10% off of next purchase of merchandise, valid for 30 days from issuance.

Rewards must be redeemed for a merchandise purchase of at least the face value (or total face value of all rewards redeemed when multiple rewards are presented in one transaction).

No cash change, check refund, or credit for the balance will be given, and a Reward(s) holds no stored value.

Rewards are valid for 90 days from date of issuance.

Rewards notifications are automatically emailed to Members every time a Member’s Program points meet or exceed one of the above point thresholds.

For every Reward issued, the corresponding points will automatically be deducted from the Member’s Program account.

PVH is not responsible for delivery of Rewards notifications. Please add vanheusen@email.vanheusen.com into your personal email address book to help ensure delivery into your email inbox.

For any merchandise returned, the value of the Rewards used towards the purchase will be forfeited. The return amount will be the non-reward sum paid.

Communication & Privacy

By enrolling in the Program, you agree that receiving communications via email is a condition of continued participation. Further, you agree that PVH may send you mail and email communications regarding the Program.

If you choose to discontinue email communications you may do so by contacting Customer Service, or by unsubscribing via the “manage my subscription” link on all emails. You will still be enrolled in the Program even if you choose to discontinue email communications. You may check your point balance and Reward status by accessing your membership account at http://www.vanheusen.com/rewards, by contacting Customer Service at 1-800-388-9122 or by emailing us via the link provided by the Contact Us section of www.vanheusen.com.

Member personal information will be held in accordance with the privacy policy set forth here.

To protect the integrity of the Program, we regularly screen activity which occurs in connection with our Members’ accounts and will notify you using the email address you provided in connection with your account if we notice any suspicious activity.

Changes to Terms & Conditions

PVH has the right, in its sole discretion, to modify, add or delete any of the Program rules, terms, conditions, or benefits, in whole or in part, at any time, with or without notice, even though such changes may reduce (or increase) the value of the Rewards or a Member’s benefits, except where prohibited by law. Continued participation in the Program constitutes acceptance of any modifications, additions or deletions.

Program Termination

The Program has no predetermined termination date, and may continue until such date as PVH, in its sole discretion, designates as the termination date. PVH has the right to end the Program at any time without providing written notice to participants.

PVH reserves the right in its sole discretion to suspend, terminate or refuse your current and/or future Rewards or Program membership if it believes any breach of the Program Terms & Conditions has occurred. Any Rewards issued that are based on false or fraudulent information or activity are subject to forfeiture. The failure by PVH to act on any breach of the Program Terms & Conditions by you shall not constitute a waiver of PVH’s right to act with respect to any breach of the Program Terms & Conditions.

Program Limitations

PVH is not responsible for failures or malfunctions of computer or data transmission systems; interrupted or unavailable network, server or other connections; or any technical problem in connection with the Program, Program administration, point accumulation or Reward issuance. PVH reserves the right, in its sole discretion, to void points or Rewards of any Member who PVH believes has attempted to tamper with, influence or impair the administration, security or fairness, of the Program.

CAUTION: ANY ATTEMPT BY A MEMBER TO UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PVH RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH MEMBER TO THE FULLEST EXTENT OF THE LAW.

By participating, you agree that 1.) any and all disputes, claims, and causes of action arising out of or connected with the Program, or any Rewards awarded, shall be resolved individually, without resort to any form of class action; 2.) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and shall not include any punitive, consequential or other damages, including costs associated with entering the Program but in no event attorneys’ fees; and 3.) under no circumstances will any Member be permitted to obtain any award for, and Member hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or the rights and obligations of Members and PVH, shall be determined by PVH in its sole and absolute discretion. These rules shall be governed by, and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York. Any legal proceedings arising out of the Program shall be instituted only in the federal or state courts located in the State of New York, and Members consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating hereto.

PVH reserves the right to cancel your membership at its sole discretion.
